With reference to your letter No.

2472 of the 16th. inst., and previous correspondence re- lative to the proposed diversion of the Albany Nullah, I am directed to remind you that the Nullah is the pro- perty of the Colonial Government and cannot be diverted without its sanction. The Colonial Government has no ob.. jection to the diversion of the nullah as desired by the Baual authorities, nor to the handing over to the Haval anthorities of the crown land of the present nullah, but the Government will only consent to this course on the condition named in my letter No.1431 of the 9th.inst. If

this condition is not accepted, the Government will ob-

ject to any diversion of the Nullah.
